8. Lodgement and Withdrawal of Caveat

Lodgement and withdrawal of caveats is undertaken by Human Services Legislation & Legal Services Branch and is arranged through Human Services Capital Management Branch.

Lodgement

The following documents must be supplied with each request for lodgement of a caveat:

  • Executed Property Deed of Charge
  • Copy of Certificate/s of Title
  • Copy of Organisation's certificate of exemption from Stamp Duty
  • Human Services cheque for lodgement fee made payable to "Registrar of Titles"

Following lodgement of the caveat, Human Services Capital Management Branch will arrange for a certified copy of the Certificate/s of Title bearing the caveat. This will be supplied together with the Property Deed of Charge to the Human Services unit that requested the lodgement for inclusion on the unit's property file.

Withdrawal

The request for withdrawal of a caveat must provide advice on whether the withdrawal is conditional on Human Services being reimbursed for its financial interest in the property or whether approval has been given for the Human Services proportion of the sale proceeds to be retained by the Organisation and applied to another property transaction. This has a bearing on the arrangements for settlement required by Human Services Legislation & Legal Services Branch.

The following documents must be supplied with each request for withdrawal of a caveat:

  • Copy of Organisation’s certificate of exemption from Stamp Duty
  • Human Services cheque for withdrawal fee made payable to "Registrar of Titles"
